Terms of Service

1. Acceptance of Terms

By using the Site or engaging Jersey Epoxy for Services, you represent that you (a) are at least 18 years old, (b) have the legal authority to enter into these Terms, and (c) agree to comply with these Terms and all applicable laws. If you are entering into these Terms on behalf of a business or other entity, you represent that you have the authority to bind that entity.

2. Description of Services

Jersey Epoxy provides epoxy flooring installation, repair, maintenance, sealing, and surface preparation services for residential, commercial, and industrial customers in New Jersey and Eastern Pennsylvania. Specific service offerings include:

• Garage floor coatings
• Basement floor coatings
• Pool deck and patio coatings (excluding salt water pools)
• Resinous flooring systems
• Flaked and metallic epoxy flooring
• Polished concrete
• Polyaspartic coatings
• Commercial and industrial flooring

The specific scope, materials, schedule, and price for each project are set forth in a written estimate or work order between Jersey Epoxy and the customer.

3. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use the Site or engage our Services. By using the Site, you represent and warrant that you meet these requirements.

4. Quotes, Estimates & Pricing

Online quote estimates generated through our website are preliminary estimates only based on the information you provide. They are not binding contracts and are subject to change based on:

• An in-person inspection of the work area
• The actual condition of your concrete or substrate
• Square footage measurements taken on-site
• Materials selected and any optional add-ons (stem walls, non-slip additives, etc.)
• Site accessibility, prep work required, and any unforeseen conditions

A binding price will be provided in a written estimate after our team has assessed the project on-site. Estimates are typically valid for 30 days unless otherwise stated.

5. Scheduling & Cancellations

Installation dates are scheduled by mutual agreement after a written estimate is accepted. Weather, site conditions, supply availability, and prior project delays may require us to reschedule. We will give you as much notice as reasonably possible.

If you need to cancel or reschedule a confirmed installation, please contact us at least 48 hours in advance. Cancellations within 48 hours of the scheduled start may be subject to a deposit forfeiture or rescheduling fee, as set forth in your written agreement.

6. Workmanship & Warranty

Jersey Epoxy stands behind the quality of our work. Specific warranty terms (duration, coverage, exclusions) are set forth in the written work order or estimate provided for each project. Unless stated otherwise:

• We warrant our installation workmanship for a period stated in your written agreement
• Material warranties (peeling, cracking, delamination) are governed by the manufacturer's warranty for the specific product used
• Warranty coverage requires reasonable use, normal wear, and adherence to recommended maintenance procedures

Warranty exclusions include, but are not limited to: damage from impact, abrasion beyond normal wear, harsh chemicals not appropriate for the coating, exposure to salt water, surface damage from improper cleaning agents, modifications by other contractors, and damage caused by structural issues with the underlying substrate that pre-existed our work.

7. Site Conditions & Customer Responsibilities

To ensure a successful installation, customers agree to:

• Provide reasonable access to the work area, including parking for our vehicles and equipment
• Remove personal items, vehicles, and obstructions from the work area before our team arrives
• Ensure adequate ventilation and electrical access at the site
• Disclose known issues with the substrate (cracks, moisture, prior coatings) before work begins
• Keep children and pets away from the work area during installation and curing

Jersey Epoxy is not responsible for damage to items left in the work area or for delays caused by site conditions outside our control.

8. Payment Terms

Specific payment terms (deposit, progress payments, final balance) are set forth in your written estimate or work order. Unless otherwise agreed:

• A deposit may be required to schedule installation
• The remaining balance is due upon completion of the work
• We accept the payment methods listed on your written estimate (cash, check, credit card, ACH)
• Past-due balances may accrue interest at the maximum rate permitted by New Jersey law
• Customer is responsible for any costs of collection, including reasonable attorneys' fees, on past-due amounts

9. Intellectual Property

The Site, including all text, graphics, photographs, logos, code, design, and other content (collectively, the "Content"), is owned by Jersey Epoxy or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and print Content for your personal, non-commercial use. You may not reproduce, distribute, modify, transmit, reuse, repost, or use the Content for public or commercial purposes without our prior written consent.

"Jersey Epoxy" and our logo are trademarks of Jersey Epoxy. All other trademarks displayed on the Site are the property of their respective owners.

10. User Submissions

If you submit photos, reviews, testimonials, or other content to us (whether through the Site, email, text message, or social media), you grant Jersey Epoxy a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content in connection with our marketing and business operations. You represent that you have the right to grant this license and that the content does not infringe any third party's rights.

11. SMS Terms

If you provide your mobile number and opt in to receive text messages from Jersey Epoxy (whether through our website forms, verbally during a phone call, or by initiating a text), you agree to the following terms:

11.1 Consent

You consent to receive SMS and voice messages from Jersey Epoxy at the mobile number you provided, sent using an automatic telephone dialing system or autodialer. Your consent is not required to purchase any goods or services from us.

11.2 Types of Messages

You may receive transactional messages (appointment confirmations, scheduling, on-the-way alerts, quote follow-ups), conversational replies from our team, and (only if you separately opt in) promotional messages such as seasonal specials.

11.3 Frequency

Message frequency varies based on your project and inquiries. Most customers receive between 2 and 10 messages per active project.

11.4 Costs

Standard message and data rates may apply for any messages sent to or from you. Check with your wireless carrier about your text and data plan. Carriers are not liable for delayed or undelivered messages.

11.5 Opting Out

Reply STOP to any message to cancel. After replying STOP, you will receive one final confirmation and no further messages. To opt back in, sign up again as you did the first time.

11.7 Privacy of Your Mobile Information

Mobile information collected through our SMS program will not be shared, sold, or rented to third parties or affiliates for marketing or promotional purposes. We use your phone number and message content solely to provide the messaging service. See our Privacy Policy for full details.

11.8 Supported Carriers

AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, US Cellular, Virgin Mobile, MetroPCS, and most other US carriers.

12. Acceptable Use

You agree not to use the Site or our Services to:

• Violate any applicable law or regulation
• Infringe any third party's intellectual property, privacy, or other rights
• Submit false, misleading, or fraudulent information
• Transmit any virus, malware, or harmful code
• Attempt to gain unauthorized access to any portion of the Site or our systems
• Use automated means (bots, scrapers) to access the Site without our written consent
• Harass, threaten, or harm any person, including our employees
• Interfere with or disrupt the Site or the services of any other user

13. Third-Party Links & Services

The Site may contain links to third-party websites, services, or resources (such as social media platforms, mapping services, or partner sites). We do not control, endorse, or assume responsibility for the content, products, services, or practices of any third party. Your use of third-party services is subject to those parties' terms and policies.

14. Disclaimers

The Site and Site content are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Jersey Epoxy disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Information on the Site (including pricing estimates, project timelines, and product descriptions) is provided for general informational purposes and is subject to change without notice.

Service-specific warranties for installed work are governed by Section 6 and your written work order.

15. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Jersey Epoxy, its officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or goodwill, arising out of or in connection with your use of the Site, our Services, or these Terms, regardless of the legal theory (contract, tort, statute, or otherwise) and even if Jersey Epoxy has been advised of the possibility of such damages.

To the extent that limitation of certain damages is not permitted by law, Jersey Epoxy's total cumulative liability arising out of or relating to these Terms or your use of the Site or Services will not exceed the greater of (a) the total amount you paid Jersey Epoxy in the 12 months preceding the event giving rise to the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Jersey Epoxy, its officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or Services
• Your violation of these Terms
• Your violation of any third party's rights, including intellectual property or privacy rights
• Any content you submit to us

17. Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Subject to the arbitration clause in Section 18, any legal action or proceeding arising out of or related to these Terms or the Site must be brought exclusively in the state or federal courts located in Ocean County, New Jersey, and you consent to the personal jurisdiction of such courts.

18. Dispute Resolution & Arbitration

Please read this section carefully, it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our Services (a "Dispute") will first be addressed through good-faith informal negotiation. Either party may initiate informal negotiation by sending written notice describing the Dispute and requested resolution to the other party. The parties will have 30 days to resolve the Dispute informally.

If the Dispute is not resolved through informal negotiation, the Dispute will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in Ocean County, New Jersey, or another mutually agreed location. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Exceptions: Either party may bring an individual action in small-claims court for disputes within the court's jurisdiction. Either party may also seek injunctive or equitable relief in court to protect intellectual property rights pending arbitration.

Opt-out: You may opt out of this arbitration agreement by sending written notice to Jersey Epoxy at the address in Section 23 within 30 days of first agreeing to these Terms. Your opt-out notice must include your name, address, and a clear statement that you opt out of the arbitration agreement.

19. Class Action Waiver

You and Jersey Epoxy agree that any Dispute will be brought in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims, may not preside over any form of representative or class proceeding, and may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

20. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Upon termination, the provisions of these Terms that by their nature should survive (including Sections 9, 11, 14–19, and 23) will remain in effect.

Termination of Site access does not affect ongoing service contracts, which are governed by their own written terms.

21. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and any written estimate or work order between you and Jersey Epoxy, constitute the entire agreement between you and Jersey Epoxy regarding the Site and Services and supersede all prior or contemporaneous communications.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. No waiver of any provision will be deemed a continuing waiver.

22. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Material changes will be communicated through a prominent notice on the Site. Your continued use of the Site or Services after the updated Terms are posted constitutes your acceptance of the changes.
